Request to Amend Coffs Harbour Local Environmental Plan 2013 - Planning Proposal PP-2021-4602

Council at its Ordinary meeting of 14 October 2021, resolved to initiate an amendment to Coffs Harbour Local Environmental Plan (LEP) 2013 to amend the minimum lot size for Lot 1 DP 726095, 14-22 Smiths Road, Emerald Beach.

The objective and intended outcome of this planning proposal are to amend the Coffs Harbour LEP 2013 Lot Size Map, as it relates to 14-22 Smiths Road, Emerald Beach, from 1 hectare to 5000 m2. The site contains an existing approved detached dual occupancy and an adjustment to the minimum subdivision lot size that applies to the property will allow the two dwellings to be separated via a two-lot Torrens Title subdivision.

On the 4 November 2021, the Minister for Planning and Public Spaces, determined pursuant to Section 3.34(2) of the Environmental Planning and Assessment Act 1979 that the proposed LEP amendment could proceed.

In accordance with the Minister’s determination and Council’s resolution, the proposed LEP amendment is now publicly available for community consultation.

The exhibition period is from Friday 3 December 2021 to close of business on Friday 17 December 2021.

The Government Information (Public Access) Act 2009 requires Council to provide public access to information held unless there are overriding public interest considerations against disclosure. Any submissions received will be made publicly available unless the writer can demonstrate that the release of part or all of the information would not be in the public interest. However, Council would be obliged to release information as required by court order or other specific law.

Written submissions must be accompanied, where relevant, by a “Disclosure Statement of Political Donations and Gifts” in accordance with the provisions of the Local Government and Planning Legislation Amendment (Political Donations) Act 2008 No. 44.
