Complying Development Certificates

Complying development is a combined planning and construction approval pathway for small scale, low impact developments which meet specific development standards.

The types of development include the construction of, and alterations and additions to dwellings and ancillary structures such as outbuildings and swimming pools along with various types of commercial and industrial development, that are classified as complying development with the criteria applicable to each development type largely contained in the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.

Prior to construction commencing

Step 1.Confirm your development satisfies all the criteria for Complying Development

You will need to identify all the constraints applying to the land and ensure the proposed development meets all the applicable Complying Development requirements. Please refer to the NSW Government's Planning Portal Spatial Viewer and Guide to Complying Development which identifies the land constraints and initial documents (Planning Certificates, certificate of title and survey plans) that will help determine if the Complying Development approval pathway is applicable for your proposal or whether you need to lodge a Development Application.

Step 2.Prepare your application

The application must include all the information and documents specified in the Environmental Planning and Assessment Regulation 2021 Part 6 Division 1 and be lodged on the NSW Planning Portal. The plans must be completed to a recognised drawing standard prepared by a suitably qualified Draftsperson or Architect and be accompanied by an industry recognised Building Specification, relevant Structural Engineering Plans, applicable BASIX certificate, Bushfire Attack Level Certificate, Flood Certificate and Stormwater Management Plans.   

Note: If the development is in proximity to infrastructure, including water, stormwater and sewer mains, electricity power lines and telecommunications facilities, concurrence from the relevant infrastructure authority should be sought and any relevant approvals (Sec 138 Roads Act, Sec 68 Local Government Act) issued prior to lodging the application.

Step 3.Register for an account with the NSW Planning Portal and submit your application

You will need to register for an account with the NSW Planning Portal to access and submit a Complying Development Certificate Application and complete a Principal Certifier Appointment.

Step 4.Your application is reviewed

Once your application is submitted, payment of a preliminary assessment fee of $250.00 is required to have the application reviewed by our Certification Team to ensure the proposal can be undertaken as Complying Development.  The application must meet the requirements for lodgement and all the relevant supporting information is to be included in the application. Upon completion of the preliminary assessment, you will be provided with a response outlining any additional information that is required to accept the application or advised if the application cannot be assessed as Complying Development. Any additional information requested will be required to be submitted within 14 days of the request, or the application will be returned. Once the application is accepted, $150.00 of the preliminary assessment fee will be deducted from the additional fees applicable for finalising and issuing the Complying Development Certificate and completing the necessary inspections required to complete the development to occupation stage. Should the application remain incomplete, withdrawn after review or not eligible to be undertaken as Complying Development, no refund of the preliminary assessment fee is available.

Step 5.Your application is assessed and determined

Your application will then be assigned to a Certifier in our Building Certification Team for assessment in as little as 20 days of your application being accepted.

If your application is approved by the City, you will receive a Complying Development Certificate subject to mandatory conditions. A Complying Development Certificate is a legal document, and the development must be constructed and operated according to the requirements of those conditions.

Step 6.Next Steps

Once you have received your Complying Development Certificate and at least 48 hours before work commences, you must submit a notice of intention to commence works logging into you Principal Certifier Application on the NSW Planning Portal.

Mandatory critical stage inspections will be undertaken during the course of construction as outlined on the Complying Development Certificate schedule of conditions, with inspections to be booked via the City’s online form (Inspection Booking Request | City of Coffs Harbour)

On completion of the development, an application for an Occupation Certificate is required to be lodged via the NSW Planning Portal (Apply for an Occupation Certificate) along with all required certification compliance certificates. On completion of the final inspection to confirm the development has been completed in accordance with the approval and is considered fit for occupation, an Occupation Certificate will be issued.
