Coffs Harbour Local Environmental Plan 2013 (Amendment 38) - Planning Proposal PP-2021-5514; and Draft Coffs Harbour Development Control Plan 2015 – Amendment No 30 (Gaudrons Road Sapphire Beach)
Council at its Meeting of 27 April 2023, resolved to initiate an amendment to Coffs Harbour Local Environmental Plan (LEP) 2013 to rezone land at 9-9A and 148-158 Gaudrons Road, Sapphire Beach, Lot 11 DP 1141269, and Lot 7 DP 555490. Council also resolved at the same meeting to publicly exhibit draft amendments to Coffs Harbour Development Control Plan (DCP) 2015 to reflect the intent of the proposed LEP amendment.
The objective and intended outcomes of the proposed LEP Amendment are to:
- amend Coffs Harbour LEP 2013 to rezone two lots located at 9-9A and 148-158 Gaudrons Road, Sapphire Beach from Zone RU2 Rural Landscape to Zone R5 Large Lot Residential; and
- reduce the minimum lot size from 40 hectares to 6000 m2 and 1 hectare respectively.
On the 23 May 2023, the Minister for Planning and Public Spaces, determined pursuant to Section 3.34(2) of the Environmental Planning and Assessment Act 1979 that the proposed LEP amendment could proceed and authorised Council to exercise its delegation to make the Plan.
In accordance with the Minister’s determination and Council’s resolution, the proposed LEP and draft DCP amendment are now publicly available for community consultation.
The exhibition period is from Monday 31 July 2023 to close of business on Monday 28 August 2023. The proposed LEP and draft DCP amendment can be viewed online on the City’s Have Your Say Page: www.haveyoursay.coffsharbour.nsw.gov.au where online submissions can be made. Written submissions can also be made to the General Manager, City of Coffs Harbour, Locked Bag 155, Coffs Harbour 2450, or emailed to coffs.council@chcc.nsw.gov.au.
The City is committed to openness and transparency in its decision making processes. The Government Information (Public Access) Act 2009 requires the City to provide public access to information held unless there are overriding public interest considerations against disclosure. Any submissions received will be made publicly available unless the writer can demonstrate that the release of part or all of the information would not be in the public interest. However, the City would be obliged to release information as required by court order or other specific law.
Written submissions must be accompanied, where relevant, by a “Disclosure Statement of Political Donations and Gifts” in accordance with the provisions of the Local Government and Planning Legislation Amendment (Political Donations) Act 2008 No. 44.
